The Legal Deputy of the Presidency Urges the Ministry of Health to Expedite the Mechanism for Private Sector Activity in Health-Focused Platforms Without the Need for a New License. Based on this, the legal deputy has approved the activity of health-focused platforms in the field of medicine and pharmacy and has asked the Ministry of Health and other relevant authorities to determine their operating conditions as soon as possible.
According to IDEA, The Legal Deputy of the Presidency has authorized the activity of health-focused platforms and has asked the Ministry of Health and other relevant agencies to expedite the necessary preparations for their operations.
The Center for Electronic Commerce Development, in cooperation with the Ministry of Health and the Medical Council, provided the infrastructure for the qualification and accreditation of service providers on platform-based services in Ordibehesht 1400 (April-May 2021). However, the Ministry of Health, which was responsible for defining the framework for the activities of these platforms, has not taken any action in this regard. In some cases, they have even opposed the activities of these platforms.
During a meeting held to assess the status of the activities and improvement of services provided by health-focused platforms, the Legal Deputy of the Presidency requested the Ministry of Health to promptly fulfill its legal obligations, which it had previously been tasked with but had not yet implemented.
According to Article 8 of the regulations for supporting knowledge-based production and entrepreneurship in the health sector, the Ministry of Health, in cooperation with the Ministry of Communications, was obligated to approve the intelligent automation plan for the supply chain of health-centered services and products within two months, taking into account the elements of regulatory and operational governance. Although this requirement was set for the Ministry of Health, it has not taken any action in this regard to date and has often taken measures to restrict the activities of drug-selling platforms.
Therefore, the Legal Deputy has requested this ministry to promptly fulfill the assigned tasks in this guideline within a maximum of two weeks and report the results to the Legal Deputy of the Presidency.
This deputy has obligated the Ministry of Health to provide a mechanism for the operation of platforms in a way that no new licenses are required. Furthermore, accreditation should be based on clear and specific criteria to create a level playing field for activities, and monitoring should be done in a smart and retroactive manner on the platforms.
In addition to requesting the Center for Electronic Commerce Development to verify the identity of users of health-focused platforms, the Legal Deputy has also obliged the CERTA Center to provide access to the unified panel monitoring of online businesses for retroactive and specialized monitoring. This includes the ability to record warning alerts and provide notice periods to businesses for rectifying violations, which will be placed at the disposal of the Ministry of Health, Treatment, and its subsidiary organizations to avoid dealing with businesses without prior notice and legal formalities.
