According to Ideaagency, on September 3 last year, the Board for Deregulation and Improvement of the Business Environment ruled that online platforms can operate in the field of medicine supply, but this decision went to the Administrative Court of Justice with the objection of the Food and Medicine Organization, and now this court has given its decision on this case to It has issued profits from medicine distribution platforms.
The Court of Administrative Justice has declared in its verdict, “The activity of internet platforms for the distribution and transfer of medicine is completely legal and does not conflict with the laws and regulations of the country.” This decision was made based on the new laws in the field of data management and budget of 2023.
This decision states: “Existing directives, such as the regulations for the support of knowledge-based production and the approvals of the deregulation board, are completely legal and have enabled the operation of platforms in the field of digital health; Therefore, opposing or preventing the activity of these platforms has no legal basis. The Court of Justice also considered this decision to support digital health and easier access of patients to medical and pharmaceutical services.

“Nima Fazeli”, the head of the digital health commission of the Tehran E-commerce Association, welcomed this decision and said: “I am happy that once again citing the existing laws, the legality of delivering medicine to people through platforms has been emphasized. This positive and promising result was obtained after long efforts against the illegal and incomprehensible actions of the Food and Medicine Organization, which created problems for the platforms by undermining the existing rules and regulations and exerting unreasonable pressure.”
He emphasized: “The private sector wants constructive interaction and logical discussions with government institutions. We understand the worries and concerns of the responsible and legislative departments, and our desire has always been and is that instead of irrational and coercive measures, we are actively present in dialogue and consensus meetings with these loved ones to hear the problems and think of solutions for them together.”
Stating that “digital health activists are seeking to improve medical services by complying with legal frameworks”, Fazeli said: “Our effort in the private sector is to persuade the public sector to take a comprehensive look at the digital health issue and taking into account the interests of the country and People, because of small solvable concerns or specific cases as a result of conflicting personal or organizational interests, do not deprive the country and society of a useful whole called activity in the digital health sector; In the 21st century, amazing things are happening in this field and great achievements have been made.”
