The Ministry of Culture and Islamic Guidance announced new guidelines for licensing and monitoring the activities of digital cultural units.
According to Iran digital economy annotation, with the notification of this directive signed by Mohammad Mahdi Esmaeili, the Minister of Culture and Islamic Guidance of the 13th government, the previous directives and the previous guidelines including “Licensing regulations for the establishment and operation of digital cultural units” approved on August 17, 2015, “Licensing Instructions” Activities of Digital Cultural Unit” approved on August 25,2021 and “Regulations for Issuing Licensing and Monitoring of Commercial Activity in the Field of Supply of Goods including Visual and Audio Works through Online Media” approved on June 13, 2016 are canceled and licensing and monitoring of activities of Digital Cultural Units ( Digit), it is done according to the current instructions.
In this guideline, which was compiled with the aim of organizing and developing digital cultural activities in the country and creating a transparent and competitive environment for the activists of this field, a comprehensive definition of the digital cultural unit is provided and includes different types of digital cultural activities. Also, the licensing process is explained step by step.
This instruction defines the digital cultural unit as follows:
“Any system, place of business, legal person or organization; Under any form and title, such as group, organization, center, company, institution, store, workshop, factory, network, website, information base or online media that conducts digital cultural activity or is used for digital cultural activity.”
Types of digital cultural activities
The types of digital cultural activities, as a cultural activity based on modern information and communication technology, are as follows:
– A. Online media management
– B. Creation, preparation and supply of media software package and media processor software package
– C. Duplication of digital media and related services, for profit or for supply by the duplicator
– D. Digital publishing (online and offline)
– E. Providing any content editing services using tools based on modern information and communication technology
One of the features of this instruction is to carry out the licensing process through the national license portal . Applicants can register their application electronically and follow the licensing process.
In addition, this directive has emphasized the necessity of monitoring the activities of digital cultural units and complying with laws and regulations. Also, in order to create a suitable environment for innovative activities in the field of digital culture, necessary support has been considered.
According to this instruction, real people need at least a high school diploma or equivalent to obtain a digital cultural unit activity license.
The licensing authority for the activity of the digital cultural unit “Center for the Development of Culture and Art in the Virtual Space” has been determined. In order to issue a license, this center inquires from the Ministry of Culture and Islamic Guidance, and the Ministry of Culture and Islamic Guidance is obliged to inform the center of the answers to the inquiries within a maximum period of 2 months. Otherwise, the result of the query will be considered “qualification confirmation”.
If approved by the security center, a “license” will be issued for natural persons and a “consent in principle” for legal persons.
One of the conditions for the activity of the holders of this license is “providing the necessary access to the center or the Ministry of Culture and Islamic Guidance to monitor and review the content”.
