According to the decision of the Regulatory Authority, all licensed platforms for online businesses in the pharmaceutical sector can operate.
According to IDEA, In its seventy-seventh session, the Regulatory Authority has decided that all licensed platforms for online businesses in the pharmaceutical sector, accredited by the Union of Internet-based Businesses or other licensing authorities, can operate in drug distribution from ‘licensed pharmacies under the supervision of the Food and Drug Organization’ to the ‘end consumers’ without the need for new licenses.
This Authority has assigned responsibilities to the Food and Drug Organization and the Ministry of Health. The Food and Drug Organization is required to draft and communicate within four months the guidelines for monitoring the process of cooperation between pharmacies and platforms for the delivery of drugs to the end consumers.
The Ministry of Health is also obliged to issue, within four months, the license for online drug sales through distribution companies to pharmacies, as well as the guidelines for using platforms via distribution companies.
The Food and Drug Organization has repeatedly prohibited the operation of online drug delivery platforms and filed a lawsuit against them in 1399 (2020), but these platforms have continued their operations.
In late August, the head of the Business Environment Improvement Center stated in an interview that the Regulatory Authority had requested the Food and Drug Organization to clarify the regulations and limits of drug distribution platform activities as soon as possible and not to pursue its complaints against these platforms.
Now, with the new decision of this Authority, instead of pursuing complaints, the regulator has accepted the activities of these platforms, which are licensed by the Union of Internet-based Businesses or other licensing authorities, and the Food and Drug Organization must draft guidelines for monitoring their activities.
