The use of filter breakers is prohibited except with permission

The use of the filter breakers was banned according to the approval of the National Center for Cyber ​​Space. Also, this resolution prohibits advertising of legal entities on foreign platforms

According to Iran digital economy annotation, this is the first time that in one of the approvals, the use of anti-filters is prohibited, in the law of computer crimes, the sale of anti-filters was criminalized.

The Supreme Council of Cyberspace has declared illegal the use of filter breakers, except in cases where a legal permit is obtained, in the resolution “Examining the solutions to increase the share of internal traffic and dealing with filter breakers”.

In the note of this paragraph, a working group of 7 members should be formed to “review the organization of the state of refining tools”. This working group is formed under the responsibility of the head of the National Center of Cyberspace and the membership of the country’s attorney general, ministers of information and communications, a representative of the Islamic Revolutionary Guard Corps, two real members of the Supreme Council of Cyberspace and sends the results of the investigations to the Supreme Council.

It is forbidden to advertise legal entities on foreign platforms

Also, the Supreme Council of Cyber ​​Space has explicitly prohibited the promotion of legal entities on foreign platforms. The Ministry of Guidance, in cooperation with Broadcasting, Faraja, the Ministry of Economy and the Judiciary, is obliged to implement and provide its equipment and must submit the results to the National Center for Virtual Space every 3 months.

Also, according to paragraph one of this resolution, the Ministry of Guidance, in cooperation with the Ministries of Economy and Communications, must prepare a plan within one month to encourage content producers and businesses active on foreign platforms to operate only on domestic platforms and present it to the Council of Ministers for approval to give.

This plan should be designed in such a way that within 6 months at least 50% of the content producers of pages and channels with a large audience will transfer their activities from foreign platforms to domestic platforms.

Exclusive provision of government services on domestic platforms

According to paragraph 3 of this decree, the Ministry of Communications is obliged to provide inclusive and essential government services exclusively on the platform of internal platforms with the cooperation of the e-government interactivity working group.

This ministry is obliged to provide the possibility of providing at least two inclusive and essential government services in domestic platforms up to 6 months after notification.

Also, with the aim of meeting the need and diversifying users’ consumption document with governable mechanisms, sector regulators have been required to identify (actually or potentially) widely used foreign services and platforms within a month and to provide the technical possibility to access useful foreign services in governable formats. check and submit the criteria to the national center.

For this purpose, the solutions of “access to domestic platforms, negotiation for the establishment of a representative office in the country, diverse portals that can be governed with private sector investment and governance regulation” have been mentioned.

Mohammad Amin Aghamiri, the secretary of the Supreme Council of Virtual Space, explained about these three methods during a press conference yesterday: “One is that the platforms themselves communicate with the regulators in order to establish a legal representation in Iran. The second method is for the private sector to negotiate with foreign platforms as an intermediary to allow their presence in the country in compliance with the country’s internal laws. The third method seeks to implement laws through technical tools.

Providing sanctions-busting services

In paragraph 5 of this resolution, the Ministry of Communications is required to provide free “sanction breaker” service in order to deal with “cruel foreign sanctions”. Also, the private sector can also get a license to provide these services.
